On June 1, the Centers for Medicare & Medicaid Services (CMS) released an Interim Final Rule with Comment that gives states the most specific instructions to date about implementing H.R. 1’s new mandatory Medicaid work reporting requirements.
The rule makes it significantly harder for states to exempt vulnerable people from the work reporting requirement and will lead to even larger Medicaid coverage losses than we’ve been anticipating.
Specifically, through the rule, CMS is:
- Making it harder to demonstrate “medical frailty” and only applies this definition to people who cannot work because of their condition. This means fewer people will qualify for a medical frailty exemption, and many patients in the middle of treatment must continue to prove their condition or lose their health care and coverage.
- Prohibiting states from taking full advantage of consumer-friendly tools like self-attestation, instead requiring additional documentation, burdening working adults, caregivers, and people with disabilities.
Congressional Republicans championed the most significant health care cuts in our country’s history by claiming people with disabilities and those who depend on our nation’s safety net would keep their Medicaid coverage under H.R. 1. Republican leadership has gone so far as to say that millions of Americans will “not lose their Medicaid unless they choose to do so.” But we know that millions of people are not choosing to drop the health care coverage that keeps them and their families healthy, protected, and insured — yet their care is at risk just the same.
The policies in H.R. 1, like work reporting requirements, are harmful, costly, and ineffective — the damage should be reversed by ultimately repealing the bill. But right now, Congress must take immediate action to mitigate coverage losses and uphold their promises to protect disabled people, seniors, and all Americans who depend on Medicaid to meet their basic health care needs.
